If your helper works on what would normally be her day off, what are you supposed to do, pay her for it, or give her another day off instead? It is one of the most frequently misunderstood parts of employing a helper in Singapore, and getting it right keeps things fair and compliant. This guide breaks down off-day rules in plain language so you always know where you stand.

Start with the weekly rest day

Under the Employment of Foreign Manpower framework, your helper is entitled to a rest day each week. The specific day can be agreed between you both and does not have to fall on a Sunday. This weekly rest day is the baseline from which all the off-day rules flow, so it helps to have a regular day agreed and written down.

The one rest day that cannot be paid away

Since 1 January 2023, there is a firm rule you must keep front of mind: your helper is entitled to at least one rest day each month that cannot be compensated away. This means at least one genuine day off every month must actually be taken as rest, and you cannot replace it with payment, no matter how convenient that might seem in a busy month.

Remember the floor: at least one rest day a month must be taken as an actual day of rest and cannot be compensated. Only the remaining rest days in the month can be worked in exchange for pay or, by agreement, a day off in lieu.

Compensation: paying for a worked rest day

For the other rest days in a month, you have flexibility. If your helper agrees to work on one of these rest days, you compensate her for it. That compensation must be at least one day’s salary for the day worked. This should always be by genuine mutual agreement and discussed in advance, never simply assumed because the household is busy.

Rest day in lieu: a day off instead of pay

Some families and helpers prefer a day off in lieu rather than payment. In this arrangement, instead of being paid for a worked rest day, your helper takes a different day off to make up for it. Many helpers appreciate this because it preserves their actual rest time, which money cannot fully replace. As with compensation, this should be agreed mutually and arranged so the replacement day is genuinely free of duties.

Compensation vs in lieu: which to choose?

There is no single right answer, it depends on what suits you and your helper. A simple way to think about it:

  • Choose compensation when your helper would rather have the extra pay and is comfortable with fewer days off that month, within the rules.
  • Choose a rest day in lieu when protecting her actual rest is the priority, which supports her wellbeing over the long term.
  • Either way, never touch the one monthly rest day that must be taken as rest.
  • Agree the approach in advance and keep a simple record of what was worked and how it was made up.

Keep good records

Whichever route you take, a tidy record protects both sides. Note the rest days taken, any rest days worked, and whether each was compensated by pay or by a day in lieu. Clear records prevent disagreements and make everything transparent and fair, which is exactly the kind of trust a long working relationship is built on.

When figures or rules are unclear

Salary calculations and any updates to the rules can vary, so if you are unsure how to work out a day’s salary or how a particular arrangement should be handled, do check MOM for the current requirement. This article is general guidance, not legal advice, and the MOM website is the definitive source.
